1. Acceptance of Terms

By using WineWorx, you agree to these terms and conditions. If you do not agree with these terms, you may not use the app.

2. Description of Service

WineWorx is a digital app for managing and organizing your wine collection. The service allows you to:

  • Add wines to your collection with details and photos
  • Digitally organize your wine cooler(s)
  • Organize and search your wine collection
  • Add notes and ratings
  • Access a shared wine database with suggestions and auto-complete when adding wines

3. Account Registration

To use WineWorx, you must create an account. You are responsible for:

  • Providing accurate and complete information
  • Keeping your account information up to date
  • Protecting your password and account security
  • All activities that occur under your account

You must be at least 18 years old to use WineWorx.

4. Usage Rules

You agree NOT to use WineWorx for:

  • Uploading illegal, offensive, or inappropriate content
  • Violating intellectual property rights of others
  • Disrupting or abusing the service
  • Collecting data from other users without permission
  • Bypassing security measures
  • Commercial purposes without prior consent

5. Intellectual Property

Your Content: You retain all rights to the content you upload (photos, notes, etc.). By uploading content, you grant us a license to host and display this content for the operation of the service.

Wine Catalog Contribution: By adding wines to your collection, you agree that anonymized wine data (name, producer, vintage, country, region, grape variety, type) may be added to our shared wine catalog. This catalog is available to all users to improve the wine entry experience. No personal information, photos, notes, prices, or location data is shared.

Our Content: The WineWorx app, including design, code, and functionality, is our property and protected by copyright. You may not copy, reverse-engineer, or reuse the app without permission.

6. Payment and Subscriptions

Freemium Model: WineWorx is available as a free (Free) and paid (Premium) service.

Free Plan: The Free plan lets you use WineWorx with the following conditions:

  • Maximum of 20 bottles in your collection
  • 1 wine cooler
  • Duplicate wine feature, collection value statistics, and import/export are included at no cost
  • A one-time allowance of 50 free AI credits, shared across all AI-powered features (wine label recognition, wine search, drinking window insights, background removal, and Vinny - AI Sommelier)
  • Once the free AI credits are used up, AI-powered features require a Premium subscription

Premium Plan: The Premium subscription is available as:

  • Monthly: A month-to-month subscription that can be cancelled at any time
  • Yearly: An annual subscription

Premium unlocks unlimited bottles, unlimited wine coolers, and unlimited use of all AI-powered features (wine label recognition, wine search, drinking window insights, background removal, and Vinny - AI Sommelier) without the free-credit limit.

Billing:

  • Payments are processed through the Apple App Store (iOS). Apple's standard payment terms apply.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • You can manage and cancel your subscription through your Apple ID settings on your device.
  • Upon cancellation, you retain access to Premium features until the end of the paid period.
  • Refunds are subject to Apple's refund policy. Please contact Apple Support for refund requests.

Price Changes: We reserve the right to change prices. In the event of a price change, you will be notified at least 30 days in advance. If the price increases, you may cancel your subscription before the new price takes effect.

7. Liability and Warranties

WineWorx is provided "as is". We strive for a reliable service, but:

  • We do not guarantee that the service will always be available or error-free
  • We are not liable for data loss (make regular backups)
  • We are not responsible for damages resulting from use of the app
  • Wine prices and information are indicative and may differ from actual market values

8. Service Changes and Availability

We reserve the right to:

  • Modify, suspend, or terminate the service
  • Add or remove features
  • Perform maintenance (we will strive to notify you)

9. Account Termination

By You: You may delete your account at any time through settings. After deletion, your personal data will be permanently deleted within 30 days. Anonymized wine data that was contributed to the shared catalog will remain available to other users.

By Us: We reserve the right to terminate accounts that violate these terms or abuse the service.

10. Age Restriction and Alcohol Laws

WineWorx is intended solely for persons 18 years and older. The app is designed for managing a collection, not for purchasing or selling alcohol. Users are responsible for compliance with local alcohol laws.

11. Privacy

Your use of WineWorx is also subject to our Privacy Policy. We recommend reviewing it to understand how we handle your data.

12. Changes to Terms

We may update these terms and conditions from time to time. For significant changes, we will notify you via email or an in-app notification. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
